Controlling Morality:  Mendenhall v. Hanesbrands Inc.

After Osama bin Laden was killed, the USA was enthusiastic. But not NFL star Rashard Mendenhall who questioned the celebration of death on twitter.  His comments stirred up a twitterstorm resulting in Hanesbrands Incorporated terminating his endorsement contract on the grounds that he had violated a morality clause of which the company was the sole arbitrator.  Mendenhall sued for breach of contract.  The company lost its motion for summary judgment when the judge concluded that a jury needed to hear the case.  The lawsuit raised the questions of who should determine morality and how the lived experiences of the parties impacted the case.
